Passenger Incentives

1.1. These Terms and Conditions apply to the issue and use of the Promotion Code received through the Passenger Incentive Program issued by the West Midlands Combined Authority.

1.2. Promotion Codes are issued at the sole discretion of West Midlands Combined Authority or authorised partners.

1.3. Promotion Codes are issued for the sole use of the recipient they were offered to. West Midlands Combined Authority reserves the right to request validation before the redemption process is completed.

1.4. Promotion Codes can only be used once and will entitle the user to either a free specified ticket or journey (Travel Product) or the credit of an amount onto a Swift card that can be used to discount the cost of a specified Travel Product (Credit).

1.5. Promotion Codes can only be redeemed at www.tfwm.org.uk (Website) or in the TfWM app (the App) by entering the Promotion Code at the appropriate point on the Website or in the App.

1.6. Redemption of a Promotion Code will require the set up of a Swift Account where separate terms and conditions apply. Account holders must comply with the Swift Terms and Conditions (Swift Terms) at all times which are available at https://www.tfwm.org.uk/terms-and-conditions/

1.7. You will provide personal data to West Midlands Combined Authority through the Swift Account including the Website and App. All personal data processed by WMCA (and on its behalf) in connection with the Promotion Code will be processed (including sharing with third parties) in accordance with the data protection provisions in the Swift Terms https://www.tfwm.org.uk/terms-and-conditions/swift-card/ and the privacy notice that can be found at https://www.tfwm.org.uk/policies/privacy-and-cookies-policy/.

1.8. By redeeming a Promotion Codes you agree that Promotion Codes:

1.8.1. must be used for the intended recipient and purpose, and in a lawful manner. If you redeem, attempt to redeem or encourage the redemption of Promotion Code to which you or a third party are not entitled you may be committing a civil or criminal offence ;
1.8.2. may not be duplicated, sold, distributed, or transferred in any manner, or published directly or indirectly in any form or by any means for use by an entity other than the original recipient;
1.8.3. may be disabled by us at any time for any reason without, to the extent permitted by law, liability to us;
1.8.4. may only be used pursuant to the specific terms that we establish for such Promotion Code;
1.8.5. are not redeemable for cash, gift cards or cash equivalents;
1.8.6. cannot be used in conjunction with any other Promotion and
1.8.7. may expire prior to your use if you do not redeem and use by the date specified in the Promotion Code or such other date as may be specified by West Midlands Combined Authority.

1.9. By redeeming a Promotion Codes you also agree:

1.9.1. to provide any requests for information, including surveys by West Midlands Combined Authority or its authorised partners in relation to your use of the Promotion Code and/or Travel Products or Credits;
1.9.2. to provide any requests for information, including surveys by West Midlands Combined Authority or its authorised partners in relation to your travel habits before, during and after the redemption of the Promotion Code and cessation of any Travel Products or Credits; and
1.9.3. to be contacted by West Midlands Combined Authority in relation to the Travel Products or Credits for a period of 24 months after the redemption.

1.10. Travel Products or a Credit redeemed via a Promotion Code will be available to users within seven (7) days if issued on a new Swift Card.

1.11. Travel Products or Credits redeemed via a Promotion Code selected to be issued to an existing Swift Card must be collected and loaded to the Swift Card by using a remote Swift Collector or the App.

1.12. It is the user’s responsibility to ensure that Travel Products or Credits are collected and loaded to the Swift Card using the methods outlined in section 1.11. West Midlands Combined Authority will not be liable for any travel costs incurred as a result of the failure by the user to collect and load Travel Products or Credits to a Swift Card.

1.13. West Midlands Combined Authority reserves the right to deactivate, cancel or suspend, without notice to the Customer, Promotion Codes and/or Travel Products or Credits which have never been used or have not been used within a timeframe specified by West Midlands Combined Authority or have been used in breach of these terms or in the commission or a civil or criminal offence.

1.14. Refunds for Travel Products or journeys funded by any Credits obtained by a Promotion Code for free and at no cost to the user are not available.

1.15. Refunds for Travel Products or journeys funded by any Credits obtained by a Promotion Code at a discounted price may be available and will be based on the discounted price (with no refund to the extent the Travel Product or journey has been funded as a result of a Promotion Code) and subject to the Swift Terms available at https://www.tfwm.org.uk/terms-and-conditions/

1.16. In the case of lost, stolen or damaged Swift Cards users can apply for a replacement of their Swift Card subject to the Swift Terms available at https://www.tfwm.org.uk/terms-and-conditions/. Original Swift Cards will be cancelled to prevent any unauthorised use and a replacement fee will apply.

1.17. West Midlands Combined Authority may at its sole discretion, at any time and without notice, deactivate, cancel or suspend the right to use a Promotion Code and/or Travel Product or Creditor refuse to reissue, renew or replace a Promotion Code and/or Travel Product or Credit if West Midlands Combined Authority has reason to believe that the user is in breach of these Terms and Conditions and/or any applicable legislation or regulations. To the extent permitted by law, West Midlands Combined Authority does not accept any liability for the direct or indirect consequences arising from any deactivation, suspension or cancellation in accordance with these Terms and Conditions.

1.18. West Midlands Combined Authority may at any time amend any part of these Terms and Conditions. All revised Terms and Conditions will apply immediately, and it is the users responsibility to regularly review the Terms and Conditions in case there are any changes that affect them. 1.19. These Terms & Conditions are subject to English law and to the jurisdiction of the courts of England and Wales.
